What is a Flex Benefit Plan?
A Flex Benefit plan allows a participant to set aside dollars each year, on a pre-tax basis, to pay for qualified medical and dependent care expenses. You save federal, state and social security taxes!

New Limitation on Over-the-Counter (OTC) Medicine or Drug Claims.
Effective January 1, 2011, reimbursement claims for OTC medicines or drugs must be accompanied by a Letter of Medical Necessity from your health care provider. This does not include insulin.

Age Limit Increase for Medical Expense Claims in your Flex Plan.
Adult children’s medical expenses are now eligible for reimbursement through your flex medical expense reimbursement account until the year in which they will turn age 27.

Medicare Supplement Insurances not an eligible flex plan expense.
Medicare insurance premiums including Medicare Parts B and D, Medicare Advantage (Part C) and Medicare Supplement are not reimbursable through the flex plan because allowing them in the flex plan may violate the Medicare Secondary Payor (MSP) rules.

IRS Publication 502 provides a list of qualifying medical and dental expenses that may be eligible for flex reimbursement, although not necessarily.

Weight loss programs and special foods and beverages
The cost of a weight loss program may be an allowable flex plan expense if it prescribed by a physician to treat an existing disease. The cost of special foods or beverages that substitute for the food an individual normally consumes are not allowable expenses in the flex plan.
